Minor Works & Projects Policy.
These Terms apply to all minor works and project quotations from The Complete Carpentry Company (UK) Ltd/We/Our/Us to you.
We recommend that you print out a copy of the Terms for your records.
General
Please also click and view our Privacy Policy. The acceptance of your order will form an offer to purchase the Goods and our email accepting your order will constitute the formation of a legally binding contract between us.
If you do not accept the Terms please email us and declaring that you would like to terminate your interest.
Please note that all orders are restricted to customers from mainland UK. For customers on the Isle of Man, Isle of Wight, Channel Islands, Western Isles & Northern Ireland, please contact us and we will be glad to advise you of our services to these areas.
All orders that you place will be subject to acceptance in accordance with these Terms.
These Terms may be amended at any time by the Complete Carpentry Company Ltd. They may also be extended to include other conditions applicable to specific goods or services offered by the Complete Carpentry Company Ltd from time to time.
It is your responsibility to read the Terms every time you place an order.
Minor Works & Projects Assumptions
It is assumed that the site will be cleaned, clear and with access and the necessary permits in place as the agreed mobilisation date. Delays in access from the client side could result in additional costs being incurred and charged accordingly.
In order to allocate labour and appropriate resource, we may need to carryout test or sample works on site, any change to the agreed date or process can affect the commencement of the project and the final completion date. This could result in additional costs being incurred and charged accordingly.
Project start up or completion delays due to inadequate information, a change of plans or incomplete or delayed third party works are the responsibility of the client and any additional costs incurred as a result will be chargeable.
The building is structurally sound and free of asbestos and RAAC.
Legacy wiring complies with the latest NICEIC regulations in order for us to sign off any alterations to the circuits. The consumer unit from which power is drawn will take any extra load for any new power or lighting.
Legacy plumbing is suitable to connect to and does not require upgrading.
Upon raising a purchase order for the works(s) you accept our terms and conditions.
In the absence of a full quote with a line by line breakdown all initial project costs were submitted under the commonly accepted disclaimer: ‘we will not be able to issue a final price until a full site and needs survey has been undertaken, we will therefore apply an emergency price and submit invoices if the specification, scope of works, or status of works has to change, the client will incur extra costs which will be charged accordingly; any time related agreements will be suspended as timescales are subject to change.
Should any of the content in this quote be used to secure competitive quotes, the Complete Carpentry Company (UK) Ltd. reserve the right to charge 10% of final value should we be unsuccessful unless permission has been given by the Director(s) in writing.
All prices exclude VAT and are subject to a final detailed survey, we call this a technical survey and acceptance of our terms and conditions through a received purchase order or deposit. All of our quotations are valid for 30 days, unless permission has been given by the Director(s) in writing.
Unless stated in our Preliminaries, Authorisations and Technical Packs which you will receive once the works are complete, the below are excluded unless agreed by the Director(s) in writing, these include and are not limited to:
• additional alarm wiring
• additional smoke sensors or fire related deactivation
• addition asbestos or RAAC related remedial work
• additional works required by building regulations
• additional emergency light fittings
• additional latex to sub floor
• additional upgrades to the consumer board as a result of over loading the circuits.
• additional installation or removal of blinds
• additional extractor fans
• additional gas workOur price includes proposal full supervision and site management and H&S management of works. All waste arising will be removed from site at no charge to the client unless stated otherwise and the workplace will be kept in a tidy condition to minimise disruption to the workplace activities. On completion we will clean all areas ready for occupation.
A pre-project invoice for a minimum of 40%, for projects over £200,000 (two hundred thousand pounds sterling) this may be more, this amount will be required up front to cover materials needed, along with any relevant consultancy and administration and purchasing on commencement of the project.
Goods and Works
The terms "goods" and “works” means the items purchased by you from us via this website or order form, the sale and supply of which are subject to these Terms; the Complete Carpentry Company Ltd will sell and you will purchase the Goods on these Terms.
The Complete Carpentry Company Ltd reserves the right to make changes in the specification of the goods and works which are required to conform to any applicable statutory or EC requirements, or where the Goods are to be supplied to the Complete Carpentry Company Ltd specifications, which do not materially affect their quality or performance. Whilst all sizes and measurements are approximate only, we will use our best endeavours to ensure that they are as accurate as possible.
Orders
The Complete Carpentry Company Ltd reserves the right in its absolute discretion at any time and without notice to remove, amend or vary an order, which appears on any page of the Web Site.
Our service is directed towards businesses, and it is assumed that each order is placed on behalf of a business.
By your acceptance of these terms, you confirm that you have the necessary authority to bind the business you are placing the order on behalf of.
You agree, by your acceptance of these Terms, that any material, information and ideas that you transmit to the Complete Carpentry Company Ltd or otherwise shall become and shall remain the property of the Complete Carpentry Company Ltd.
Price
The price of the Goods will be Complete Carpentry Company Ltd quoted price and is exclusive of Value Added Tax, and all costs or charges in relation to packaging, loading, unloading, carriage and insurance.
The Complete Carpentry Company Ltd reserves the right, by giving notice to you at any time before delivery, to increase the price of the Goods to reflect any increase in the cost to Complete Carpentry Company Ltd which is due to any factor beyond the control of Complete Carpentry Company Ltd (such as, without limitation, any foreign exchange fluctuation, currency regulation, alteration of duties, significant increase in the costs of labour, material or other costs of manufacture).
Any such increase in price shall be intimated to you and you shall have a period of five working days to confirm whether you wish to proceed with the Order.
Your failure to reply to our said intimation will be deemed to be acceptance of the price increase.
Any increase in price due to a change in delivery dates, quantities or specification of the Goods which is requested by you, or any delay caused by any instructions of you or failure of you to give the Complete Carpentry Company Ltd adequate information or instructions may also result in an increase in price, which will not be subject to further agreement by you.
We try and make sure that all prices on our quotes are up to date but occasionally errors may occur. If we identify a pricing error with the goods you have ordered, we will attempt to contact you and you can both accept the correct price and confirm you wish to proceed with the new order or cancel it. If we are unable to contact you, we will automatically cancel the order and if a refund is due, you will be refunded.
Payment
The Complete Carpentry Company Ltd require payment in full when an order is placed, this is to allow your item to be manufactured in the bespoke configuration. If you fail to make payment the Complete Carpentry Company Ltd will be entitled to cancel the contract or suspend delivery of the Goods to you until payment is made in full.
The client or an authorised representative must make themselves available to sign off the works, if no representation is available to sign off the works at the time of completion, then the client and The Complete Carpentry Company Ltd. will agree by default that all works have been accepted in favour of The Complete Carpentry Company Ltd. and ready for the final invoices to be submitted. The client will have five working days in which to state in writing any reasons why they do not agree to accept the works.
The payments of each invoice must be promptly paid within the agreed payment terms as set out above.
All materials delivered to site will remain the property of The Complete Carpentry Company Ltd. with title fully vested until the client has paid for the works in full and if the client defaults in respect of any obligations to make payments under the contract The Complete Carpentry Company Ltd. may enter the site and repossess and remove the materials until such time as all sums due have been paid in full, even if the materials have been installed, connected or incorporated in the works, in which case The Complete Carpentry Company Ltd. may uninstall, disconnect and remove the same.
Under the Late Payment of Commercial Debts (Interest) Act 1998 The Complete Carpentry Company Ltd. reserves the right to charge interest and compensation above the current Bank of England base rate on any balance’s outstanding after the invoice due date and until the debt is settled in full.
Interest will accrue on a daily basis from the due date until the actual date of payment, whether before or after judgment and may include debt recovery and legal fees in relation to the amount owing.
Delivery
The Complete Carpentry Company Ltd is restricted to the delivery of Goods to the UK mainland only. For customers on the Isle of Man, Isle of Wight, Channel Islands, Western Isles & Northern Ireland, please contact us and we will be glad to advise you of our services to these areas. There will be an additional delivery charge for AB and DD and postcodes in the Highlands and Islands and deliveries in the Channel islands and Ireland.
Delivery of the Goods will be made once the Goods have been delivered to the place of delivery notified by you to the Complete Carpentry Company Ltd and the accompanying consignment note has been signed by an individual aged 18 or over on your behalf.
It will be your responsibility to check that the number of boxes or items delivered matches the accompanying consignment note before signing.
We aim to deliver a very high standard of service and we will make every effort to deliver the Goods, as near to the specified delivery date as possible, however delays are sometimes inevitable due to unforeseen factors. Therefore, any dates quoted for delivery of the Goods are approximate only and the Complete Carpentry Company Ltd will not be liable for any delay in delivery of the Goods howsoever caused. Time for delivery shall not be of the essence of the contract.
The Goods may be delivered by the Complete Carpentry Company Ltd in advance of the quoted delivery date. If the Complete Carpentry Company Ltd fails to deliver the Goods for any reason other than any cause beyond the Complete Carpentry Company Ltd reasonable control or your fault, and the Complete Carpentry Company Ltd is accordingly liable to you, the Complete Carpentry Company Ltd liability shall be limited to a refund of the Price of the Goods.
It is a customer's responsibility to inform us of any access restrictions for deliveries, failure to do so may result in the delivery being postponed and a redelivery charge being incurred.
Subject to the conditions set out below, the Complete Carpentry Company Ltd warrants that the Goods will correspond with their specification at the time of delivery.
Where the Complete Carpentry Company Ltd sells Goods supplied by a Third Party, the Complete Carpentry Company Ltd does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but will assign to you the benefit of the manufacturer`s warranty given by the third party supplying the Goods to the Complete Carpentry Company Ltd.
The above warranty will be assigned by the Complete Carpentry Company Ltd subject to the fact that the Complete Carpentry Company Ltd shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, or storage in a hostile environment, failure to follow the Complete Carpentry Company Ltd instructions or a third party`s instructions (where the Goods have been supplied by a third party to the Complete Carpentry Company Ltd - whether oral or in writing) misuse or alteration or repair of the Goods without the Complete Carpentry Company Ltd approval.
Cancellation
You have a period of 14 days (the "Cancellation Period") within which to withdraw from the contract between you and the Complete Carpentry Company Ltd by notice in writing to the Complete Carpentry Company Ltd. The Cancellation Period begins the day after you have received the goods. All 3rd party goods will be considered tailor made and personalised, therefore are exempt from the 14-day cancellation period.
Returns
Without prejudice to your statutory rights, goods may only be returned if they are unused, unassembled, in their original packaging and in a resalable condition.
You will need to contact us in writing within 14 days from delivery. Goods to be returned will be collected by us or our agents.
The Complete Carpentry Company Ltd reserves the right to charge a collection charge and a minimum handling fee of 25% of the value of the goods for items returned when orders were placed in error or not wanted. This will be deducted from any refund given. Any items wishing to be returned that we deem to be 'out of area' such as Northern Ireland we would be unable to collect.
Goods to be returned will be kept safe and secure until such time as they are collected by us. Any damage to the Goods will be deducted from any refund given in addition to the minimum handling fee (if applicable) referred to above. We will refund the price of the Goods (if a refund is applicable) to you less any deductions in terms of the above clause once the Goods have been examined and within 30 days of their collection from you by the Complete Carpentry Company Ltd.
Miscellaneous
These terms constitute the entire agreement between the parties, supersede any previous agreement or understanding and may not be varied except with the prior written approval of the Complete Carpentry Company Ltd.
All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
The Complete Carpentry Company Ltd reserves the right to terminate the contract as set out in these Terms, by notice to you sent via e-mail, fax or by letter addressed to you as set out in your registration details.
